Terms of Use

Article 1 — Overview

OKTRA is a public procurement monitoring platform in Morocco, published by EXOS DATA SARL, a limited liability company under Moroccan law, registered with the Casablanca Trade Register under number [RC], with its registered office at [Full address], Casablanca, Morocco.

The platform offers the following services:

• Aggregation and indexing of public tenders in Morocco
• Advanced multi-criteria search (sector, region, budget, keywords)
• Personalized alerts via email, SMS and push notifications
• Market analysis and statistics (OKTRA Radar)
• Data export (PDF, Excel, CSV)
• Simulation tools (best offer, technico-commercial, ROI)

Article 2 — Acceptance of Terms

Use of the OKTRA platform implies full and unconditional acceptance of these Terms. If you do not accept these conditions, you must immediately stop using the platform. These Terms are binding as soon as the user accesses the platform, including simple browsing.

Article 3 — Service Access

OKTRA offers several access levels:

• Free Plan: limited access to search and 3 alerts
• Premium Plan (499 MAD/month): unlimited alerts, email and push notifications, full history
• Pro Plan (1,490 MAD/month): Premium features + AI summary, advanced analytics, unlimited export
• Enterprise Plan (4,990 MAD/month): Pro features + OKTRA Radar, API, dedicated support, multi-user

Prices are shown excluding taxes (HT) and may be modified at any time. Any price change will be communicated 30 days in advance to active subscribers.

Article 4 — Registration and Account

Registration is done via Firebase Authentication. The user agrees to:

• Provide accurate and up-to-date information
• Maintain the confidentiality of their login credentials
• Create only one account per individual or legal entity
• Immediately inform OKTRA of any unauthorized use of their account

OKTRA reserves the right to suspend or delete any account in case of violation of these Terms.

Article 5 — Subscriptions and Payment

Paid subscriptions are subject to the following conditions:

• Monthly or annual billing as chosen by the user
• Automatic renewal at each billing period unless cancelled
• Secure payment via our provider NAPS/CMI (credit card, bank transfer)
• Cancellation possible at any time, effective at the end of the current period
• No refund for the current period after cancellation

A free 14-day trial is offered on paid plans, with no commitment and no credit card required.

Article 6 — User Obligations

The user agrees to:

• Use the platform lawfully and in accordance with these Terms
• Not engage in automated data extraction (scraping) from the platform
• Not resell, redistribute or commercially exploit OKTRA data
• Respect OKTRA's and third parties' intellectual property rights
• Not attempt to compromise the security or operation of the platform
• Not create fake accounts or use fictitious identities

Article 7 — Intellectual Property

All elements of the OKTRA platform (design, source code, brand, logo, texts, features) are protected by intellectual property law and are the exclusive property of EXOS DATA SARL.

Public procurement data comes from the Moroccan Public Procurement Portal (PMMP) and other official sources. OKTRA aggregates, structures and enriches this data, constituting a protected database.

Any unauthorized reproduction, representation or extraction is subject to prosecution.

Article 8 — Personal Data

The processing of your personal data is governed by our Privacy Policy, accessible at /confidentialite. We comply with Law No. 09-08 on the protection of personal data.

Article 9 — Liability

Data relating to tenders is provided "as is". OKTRA strives to ensure the accuracy and timeliness of information but does not guarantee:

• The completeness of listed tenders
• The absence of errors in displayed data
• The suitability of information for the user's specific needs

Under no circumstances shall OKTRA be held liable for decisions made by the user based on information provided by the platform. OKTRA's liability is limited to the subscription amount paid by the user in the last 12 months.

Article 10 — Service Availability

OKTRA commits to making its best efforts to ensure platform availability 24/7. However, access may be temporarily interrupted for:

• Planned maintenance operations (with prior notice)
• Technical updates
• Force majeure (natural disaster, network failure, administrative decision)

Article 11 — Suspension and Termination

OKTRA reserves the right to suspend or terminate a user's access in case of:

• Violation of these Terms
• Fraudulent or abusive use of the platform
• Non-payment of subscription after reminder
• Prolonged account inactivity (more than 24 months)

The user will be notified by email at least 15 days before any suspension or termination, except in cases of emergency or serious violation.

Article 12 — Amendment of Terms

OKTRA reserves the right to modify these Terms at any time. Changes will be notified to users by email and/or by a notification on the platform at least 30 days before they take effect. Continued use of the platform after this period constitutes tacit acceptance of the new Terms.

Article 13 — Applicable Law and Jurisdiction

These Terms are governed by Moroccan law. Any dispute relating to the interpretation or performance of these Terms shall be subject to the exclusive jurisdiction of the courts of Casablanca, Morocco.
